These Terms & Conditions (“Terms”) govern your use of Brandiket’s website, services, and products. By engaging with Brandiket (“we,” “our,” or “us”), you (“Client,” “User,” or “You”) agree to these Terms. Please read them carefully before purchasing or using our services.


1. Scope of Services

  • Brandiket provides branding, creative, digital marketing, website design, video production, print, and subscription-based creative services.

  • Deliverables, timelines, and costs will be defined in:

    • Service listings on our website (Shopify product pages).

    • Proposals, invoices, or contracts issued directly.

  • Services may be one-time, project-based, or subscription-based.


2. Client Responsibilities

  • Accurate Information: Clients must provide correct project information, brand assets, and content.

  • Timely Feedback: Delays in approvals or feedback may affect project timelines.

  • Ownership of Materials: Any logos, images, or content provided must not infringe third-party rights.

  • Collaboration: Client must designate a main contact person for communication and approvals.


3. Payments & Billing

  • Upfront Payment: Most projects require upfront payment before work begins unless agreed otherwise.

  • Subscriptions: Billed monthly, automatically renewing unless canceled with 14 days’ notice.

  • Late Payments: Overdue invoices may incur service suspension and a late fee of up to 1.5% per month.

  • Refund Policy: Fees are non-refundable once work has commenced, except where legally required.


4. Revisions & Approvals

  • Each service package includes a set number of revisions (as stated in the package details).

  • Extra revisions are billed separately.

  • Approval of final designs, ads, or deliverables releases Brandiket from further liability for errors.


5. Intellectual Property

  • Ownership Transfer: Deliverables become client property once full payment is received.

  • Brandiket Rights: We may showcase completed work in our portfolio, social channels, and case studies unless prohibited by NDA.

  • Tools & Templates: Internal templates, processes, or code remain Brandiket’s property.


6. Confidentiality & Data Protection

  • Brandiket complies with applicable data protection laws (GDPR, CCPA, HIPAA for healthcare-related clients).

  • Client data will not be shared, sold, or disclosed except as necessary for service delivery.

  • We may use anonymized project data for analytics and improvement.


7. Marketing Performance Disclaimer

  • While Brandiket employs industry best practices, we do not guarantee specific outcomes (e.g., number of leads, revenue).

  • Results depend on variables outside our control, such as market conditions, ad competition, and client implementation of strategies.


8. Subscription & Unlimited Services

  • Fair Use Policy: Unlimited packages cover reasonable request volumes; excessive requests may be queued.

  • Turnaround Time: Standard turnaround is 1–3 business days per task depending on complexity.

  • Cancellation: Monthly services require 14 days’ cancellation notice before renewal date.


9. Trust & Safety

  • We will not accept projects involving:

    • Illegal, hateful, or discriminatory content.

    • Misleading, fraudulent, or deceptive practices.

    • Content that violates advertising policies (Google, Facebook, etc.).

  • We reserve the right to refuse projects at our discretion.


10. Liability & Indemnification

  • Brandiket’s liability is limited to the total fees paid by the client for the service in question.

  • Client agrees to indemnify Brandiket against claims resulting from use of supplied materials, content, or instructions.


11. Termination of Services

  • Either party may terminate services with written notice.

  • In case of termination, the client must pay for all work completed up to that point.

  • Prepaid subscription fees are non-refundable unless otherwise agreed.


12. Governing Law & Disputes

  • These Terms are governed by the laws of the State of Florida, USA.

  • Any disputes shall be resolved exclusively in the courts of Broward County, Florida.


13. Updates to Terms

  • Brandiket may update these Terms periodically.

  • Clients will be notified of major updates via email or website posting.

  • Continued use of services constitutes acceptance of changes.
